Rental Policy's and other Information

1. Term. The term of this vacation rental shall begin on _________ at 4pm and end __________ at 10:00am (“Check-Out Date”). The property shall be available and ready for immediate “temporary occupancy” by guest(s) during this period. Temporary occupancy in terms of this agreement means that this guest is given limited use of the above property for a limited time and is not considered a tenant under Michigan Law and hereby waives all rights or interests a legal tenant may have to this property, either by statute or common law.

2. Reservation Requirements. Reservations are not considered "guaranteed" until a signed rental lease agreement and payment of the Security/Reservation Deposit (“Security Deposit”) is received. Reservations booked forty five (45) days or less prior to arrival date will require payment in full on reservation date. All other reservations booked direct with Vista Gun Lake Rentals require an initial payment of 25%. The final rental amount (75%) is due ninety (90) days after the agreement date shown above on the first line of this agreement. If booked through VRBO/Airbnb payment due dates will be provided and followed by the booking site.

3. Accepted Forms of Payment. The Security Deposit and/or Rent payments can be paid in the following acceptable forms: Through Home Away/VRBO Secured Payments, AirBnb, Cash, Traveler's Checks, Money Order, PayPal, Guestypay or Venmo.

​

4. Security Deposit. The Security Deposit will usually be returned within seven to fourteen (7-14) business days after the Check-Out Date, provided proper check-out procedures are followed, and there is no breakage or damage to the premises and all gas in boat is replaced if rented. It is the responsibility of the guest to inform the agent if anything is broken or damaged on arrival, or during the term of the contract.

5. Confirmation of Reservation(s). Confirmation of the reservation will be emailed either by property manager or from Home Away/VRBO website or mailed to Guest(s) upon receipt of the reservation advance payment. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Any errors must be directed to the agent immediately or deemed waived.

6. Refund Policy. We have a no cancellation policy. There shall also be no refunds for early departures (less days than reserved) ~ There shall be no refunds given for delayed arrival and no refunds for advanced departure. If reservation is canceled any time after deposit being turned in but before final payment is made the deposit is forfeited and not required to be returned. However, the deposit will be returned within 30 days after check out date if “Guest” stays at the property and checks out on time and is there is nothing damaged or missing and all gasoline in the boat, if rented, is replaced. If there “Guest” cancels any time after final payment has been made they will NOT receive a refund unless we are able to re-rent the property to someone else for some or all of the dates on this agreement. Whatever amount we are able to obtain from new guest renting will go to “Guest” so they will be able to receive some or all of their monies back. If we are unable to re-rent the property to another guest then the entire final payment amount will not be returned. However, the initial security deposit will be returned.

7. Management. For purpose of this agreement and for management of this property homeowner has appointed Carla Baxter as his legal agent and manager for this property, hereinafter referred to as “Management”. Management as full authority to execute this agreement by and on behalf of Owner and all correspondence and communication should be directed to him at: 313-917-8091 or customerservice@vistagunlakerentals.com

8. Warranty. Management warrants that the home will be clean and suitable for immediate short-term occupancy upon guest arrival. Management further warrants that the general functions of the home, including water, heat, and electricity shall be in full functional order or repaired immediately, unless not at the fault of management. Management cannot guarantee against mechanical failure of heating, air conditioning, TVs, Satellite Receivers, VCRs and/or other appliances. Please report any inoperative equipment to the agent immediately. Upon notice, agent will make every reasonable effort to have repairs done quickly and efficiently. There shall be no refunds or rent reductions due to failure of appliances or equipment. Refunds or deductions shall only be made where the home is rendered not suitable to be habitable as a result of continued loss of heating, air conditioning, or water functions.

9. Guest Acknowledgment. Guest understands that this cabin is serviced by well water and a septic system and guests should refrain from flushing anything other than toilet paper in toilets. The owner further warrants that all water servicing the cottages is potable, however, as a result of the high mineral content, the water may have an odor from time-to-time.

​

10. Access. Guest shall allow Owner or its agent, subcontractor, or other parties on the premise at any time for purpose of repair, maintenance, and inspection. Owner shall exercise this right in a reasonable manner.

​

11. Act of God. Management shall not be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war or inclement weather. NO REBATE OR REFUND will be offered in these circumstances.

​

12. Age Requirements. Guests under the age of 21, unaccompanied by a parent or legal guardian will not be permitted to register and will lose all funds paid to Agent. Any reservations made under false pretenses will result in loss of advance payments and possible removal of guest from rental unit.

​

13. Entertaining. There shall be no formal events such as weddings, reunions, or additional guests,

overnight or otherwise, beyond the amount designated in paragraph fourteen (14) below unless upon the express authorization of the management and upon signing the appropriate addendum. Failure to abide by the above restriction shall result in immediate breach of this agreement and forfeiture of the security deposit

and removal from the premises. Any addendums to this agreement are hereby incorporated by reference as if fully restated herein.

14. Maximum Occupancy. At all times, the maximum occupancy is limited to fourteen (Cottage #1 (10) Cottage #2 (7) Cottage #3 (7) ) people unless otherwise expressly agreed. All persons lodging or who may be potentially on this property must be listed on the attached last page to this agreement.

​

15. Furnishings:  Furnishings are subject to change without notice. Furniture, bedding, mattress pads, utensils or any other property supplied with the rental property must not be taken out or transferred from one property to another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the guest(s).

​

16. Items Provided. The property is furnished and includes indoor bathrooms, linens, pillows and blankets, dishes, silver wear, towels, stove, BBQ grill, patio area with picnic table, dock, and flat screen TV.

​

17. Pets. Pets are permitted upon prior approval by the Owner and remittance of an additional $200.00 security deposit for each pet.

​

18. Use of Property. Guest is granted full use of the home area and all unlocked spaces and confines within. Guests may also enjoy the entire property for reasonable use and as the property is intended.

​

19. Illegal Drugs/Activities. Guest acknowledges that illegal drugs or other unlawful activities are strictly prohibited on this property, including, but not limited to noise and ordinance violations, and any other activity prohibited by Federal, State or Local law. Any ordinance or other violations incurred by Guest, shall be the sole responsibility of the Guest.

20. Parking. Vehicles are to be parked in posted designated parking areas only. Parking on the road or in neighboring lots is not permitted

​

21. Housekeeping. There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units.

​

22. Smoking. Smoking is allowed OUTSIDE ONLY and all butts must be picked up and thrown away.

​

23. Venue. Any disputes arising from this contract shall be enforced in the District or Circuit Court of Barry/Alllegan County, State of Michigan.

​

24. Indemnification and Hold Harmless. Guest agrees to indemnify and hold harmless the Owner, Management, and any Agent for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with this Guest’s use and occupancy of this property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). Guest shall further indemnify and shall hold harmless the Owner, Management, and any Agent, for any other injury, damage, or theft to third part individuals during this Guest’s on this property during their respective rental period. By accepting this reservation, Guest’s expressly assuming the risk of harm arising from the use of this property and all others they invite on the premise.

25. Additional Damages. Guest(s) acknowledges that certain items in the house have significant tangible value and may be difficult to replace. Should damages exceed the amount secured by the Guest deposit, then management reserves the right to assess additional charges based on reasonable replacement value of that item and shall be immediately due.

​

26. Choice of Law. This contract shall be construed and enforced under the laws of the state of Michigan.

​

27. Application. If any portion or portion(s) of this agreement are deemed void or unenforceable, the remaining terms in this contract shall remain in full force and effect.

​

28. Violation of Agreement - If guest(s) violates any of the conditions of this Agreement, Agent may terminate this Agreement and enter premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the premises immediately and forfeit all rents and security deposit.

​

29. Removal. Any Guest that seeks to stay beyond Check-Out Date without the express permission of the Owner or its Management shall be considered illegal trespassers and may be removed immediately by law enforcement.
